Q: Why won't Flying J quote fuel prices over the phone? A: There is no law that prevents a retailer from giving prices over the phone. However, Flying J imposed the "no prices over the phone" policy back in the early 80s when the Company was questioned during an investigation of several gasoline retailers for price fixing in Spokane Washington. Flying J was never named in the resulting indictments, but a number of its competitors were charged with price fixing. The primary evidence against these competitors was phone records showing that they communicated frequently among themselves and prices were frequently changed after such communications.
Flying J decided then to impose a "no prices over the phone" policy so that if other operators tried calling us (even if they lied and told us they were customers) they could never get our prices over the phone and no implication could therefore be drawn that we were participating in a cooperative among retailers to share and adjust prices based on some implicit or explicit agreement. Flying J has a very aggressive antitrust compliance policy and to not share pricing information with competitors is one component of it.
Unfortunately, we recognize that this policy adversely affects the ability of our customers to obtain access to our prices over the phone. Nevertheless, we have decided that the great majority of our customers don't shop fuel prices by phone and that the substantial benefit of preventing even the appearance of anti trust violations outweighs the relatively minor inconvenience that our policy imposes upon our customers. Q: Why is there a price difference on diesel fuel in Indiana for RV lanes and the commercial lanes? A: This is unique to diesel fuel sales in the State of Indiana. The "Truck Diesel" price is advertised to those customers who have a DOT registered number, which is the professional/commercial truck customer. The DOT number enables commercial drivers to pay their state sales taxes on a quarterly basis instead of at the pump. RV drivers do not have a DOT number, and pay for sales taxes at the pump. Either way, the sales taxes must be paid. To help clarify our pricing to our customer we advertise our prices as "Truck Diesel" and "Auto Diesel". Our website pricing also reflects this same concept. If you look the pricing in Indiana, the Diesel pricing is for DOT registered trucks. The gas pricing page lists the Car/RV price which includes the taxes. The Diesel #2 price is the same regardless of which lane you use to fuel, the pricing difference is related to taxes, not product or island.
